If the Agent introduces to the Client a Contractor Worker or Permanent Worker for a position which is an Actual Vacancy and the Client appoints the Contractor Worker or Permanent Worker to a different position, the Introduction Fee shall be charged as a Speculative Application.
The Authority’s requirements may vary and nothing in the Contract shall require the Authority to order or commit to ordering any particular volume or type of Temporary Workers or Permanent Workers or to use any particular Temporary Worker or Permanent Worker Introduced to the Authority.

For the avoidance of doubt, no fees will be payable by Wesleyan under this Agreement as a result of a Temporary Worker: Introduced by the Supplier subsequently engaged by Wesleyan as Permanent Worker after 6 months of employment; that, following an Assignment, is subsequently engaged by Wesleyan via another supplier; and/or Introduced by the Supplier that is subsequently introduced by Wesleyan to a third party employer (which may include a Wesleyan Subsidiary).
The Service Provider shall provide the Authority with all information it has been provided in respect of the proposed Temporary Worker or Permanent Worker and specify in the case of a Temporary Worker whether the Temporary Worker is employed by it or any sub-contractor before any Introduction.
Subject to Paragraph 6.2, if the Engagement of any Permanent Worker terminates for any reason whatsoever except redundancy, within the period of thirteen (13) weeks following the date of Engagement, the Supplier will provide a refund of the fees paid to the Supplier in accordance with Table 3 below.
