Permanent Material definition
Permanent Material means any exterior finishing material commonly used in building construction that complies with the Safety Codes Act. Without limiting the generality of the foregoing, permanent materials include but are not limited to brick, finished concrete, stone, stucco, wood, vinyl or metal siding, but does not include materials such as drywall, untreated plywood, or building wrap.

In the event Tenant desires to exercise its option to terminate this Lease as to the Condemned Site as provided for in this paragraph, Tenant shall provide written notice to Landlord on or before the later to occur of (i) thirty (30) days following the date upon which Tenant receives written notice from Landlord of a Permanent Material Taking, or (ii) the Termination Date noted below.
