Performance Penalty shall have the meaning as set forth in Exhibit E.

More Definitions of Performance Penalty

Performance Penalty means a monetary amount that may be assessed by the Co-Administrators or MCA based on the terms of the Agreement. Contractor shall pay all performance penalties to the MCA Board within thirty (30) days of the assessment. The Daviess County Fiscal Court shall hold such penalties in a separate account, and disburse such funds as recommended by the MCA.
