PBV Requirements definition

PBV Requirements means the legal requirements applicable to the Section 8 project-based voucher program including, without limitation, the Act; HUD regulations thereunder (and to the extent applicable, any HUD-approved waivers of regulatory requirements, including any such waivers that may be contained in the RAD Notice, as such term is defined herein, that are applicable to the PBV Units); any other federal laws, regulations, notices, and Executive Orders pertaining to the Section 8 project-based voucher program; the PHA’s Section 8 Administrative Plan; and the HAP Contract.
PBV Requirements mean all requirements of the PBV program, including without limitation applicable requirements of Section 8 of the U.S. Housing Act of 1937, regulations at 24 CFR Part 983, the PBV HAP Contract, and the Authority’s Section 8 Administrative Plan, but subject to any waivers issued by HUD.
PBV Requirements means all applicable requirements in connection with the management and operations of the PBRA Units.

  • The Developer shall comply with the tenant protection requirements set forth in the PBV Requirements, and the applicable provisions as set forth in more detail in the Authority’s Housing Choice Voucher Program Administrative Plan (as amended from time to time), which is the document that sets forth the Authority’s local policies for operation of its housing programs in accordance with federal laws and regulations (the “Administrative Plan”).

  • As a condition of entering into the Lease Agreement, the PHA requires and the Owner covenants and agrees for the benefit of the PHA that Owner shall extend the HAP Contract in the event that such extensions are offered by the PHA; provided however that the PHA shall only offer extensions of the HAP Contract when and to the extent permitted by the PBV Requirements, as such may be amended or replaced.

  • In the event the Housing Authority fails to refer a potential tenant to Owner pursuant to the RAD Tenant Selection Plan for a vacant unit, then Owner may lease such vacant unit to any income-eligible household selected by Owner; provided that such household is also an eligible household under the RAD Program requirements and PBV Requirements (defined herein).

  • Unless otherwise authorized by the Approved Mortgage Lenders and HUD, if required, funds placed in the Replacement Reserve (including interest thereon and additional amounts deposited therein from time to time pursuant to the terms hereof) shall constitute restricted trust funds to be applied during the term of this Agreement solely for the benefit of the Development in accordance with the terms and conditions hereof, the loan documents and the PBV Requirements.

  • In the event the Housing Authority fails to refer a potential tenant to Owner pursuant to the RAD-Specific Tenant Selection Plan for a vacant unit, then Owner may lease such vacant unit to any income-eligible household selected by Owner; provided that such household is also an eligible household under the RAD Program requirements and PBV Requirements (as defined herein).

  • In the event of a conflict between any requirement contained in this Declaration and the PBV Requirements, the PBV Requirements shall in all instances be controlling.

  • Owner shall cause the PBV Units to be operated in accordance with PBV Requirements, including but not limited to the PBV HAP Contract and the HUD Declaration.

  • The Owner shall operate the Development in compliance with the HAP Contract and the PBV Requirements for the duration of the term of the HAP Contract.

  • The Owner and PHA shall work diligently to include all eligible rental units at the Development under the HAP Contract in accordance with the PBV Requirements and the Approval.

  • Owner shall also undertake eligibility determinations for the PBV Units in accordance with the PBV Requirements and the PACT Principles.

  • Listing Requirements means the Main Market Listing Requirements of Bursa Securities.

  • Service Requirements means the specification that the Flexibility Services must be capable of meeting, as defined in Schedule 1;
