PBM Contract definition

PBM Contract means that certain Pharmacy Benefit Management Services Agreement to be entered into between the Seller and the Company on the date the Acquisition is consummated.
PBM Contract shall have the meaning set forth in the Recitals.

  • PBM shall ensure that all tasks related to the Agreement are performed in accordance with the terms of the Agreement and the TennCare PBM Contract.

  • As specified in section D.19 of the PBM Contract, Provider or collection agencies acting on Provider's behalf may not bill Covered Persons for amounts other than applicable TennCare cost sharing or Patient Liability amounts for Covered Services, including but not limited to, services that the State, Health Plan or Subcontractor has not paid for, except as permitted by the Division of TennCare rules and regulations and as described below.

  • For purposes of this Appendix, the following terms shall have the meanings set forth below; provided, however, in the event any definition set forth in this Appendix or the Agreement is inconsistent with any definitions under the applicable PBM Contract, the definitions shall have the meaning set forth under the applicable PBM Contract.

  • During the contract period of the PBM Contract, these records shall be available at Provider’s chosen location in Tennessee subject to the written approval of Health Plan, Subcontractor and TennCare.

  • If any requirement in this Agreement is determined by TennCare to conflict with the TennCare and PBM Contract, such requirement shall be null and void and all other provisions of this Agreement shall remain in full force and effect.

  • Provider shall cooperate with Health Plan’s policies and procedures and comply with section D.8 of the PBM Contract related to detecting and preventing conflicts of interest from occurring at all levels.
