To the extent that Payment Labs provides or makes available Identity Verification Services (as defined in Exhibit D) to Company, said Identity Verification Services shall be provided in accordance with and shall be subject to the Identity Verification Services Terms attached hereto as Exhibit D.
Payment Labs is not responsible for the Company’s failure to provide timely notification of the satisfaction of the purpose for which Biometric Data was collected with respect to any given Biometric User.

The manner and notice of expiration, nonrenewal or other form of termination of this Agreement are reasonable and, upon such termination, whether with or without cause, no payment, compensation or indemnity for loss of goodwill or accounts, or prospective profits, or any other damages, indemnity or loss shall be due of Payment Labs.
Any business or product that would cause Payment Labs to violate any law or Card Association Rule or would expose Payment Labs to any regulatory or enforcement risk.
To the extent necessary for the purging or deletion of such Biometric Data, Company agrees to provide timely notification to Payment Labs of the satisfaction of the purpose for which Biometric Data was collected with respect to any given Biometric User.
Company shall comply with the Payment Card Industry Data Security Standard (PCI DSS) and all other applicable security requirements as required by Payment Labs, any Card Association, or applicable law.
