Pathnet shall have the meaning set forth in the preamble to this Agreement.

BellSouth shall be named as an ADDITIONAL INSURED on ALL applicable policies as specified herein. 8.2.2 Statutory Workers Compensation coverage and Employers Liability coverage in the amount of one hundred thousand dollars ($100,000.00) each accident, one hundred thousand dollars ($100,000.00) each employee by disease, and five hundred thousand dollars ($500,000.00) policy limit by disease. 8.2.3 Pathnet may elect to purchase business interruption and contingent business interruption insurance, having been advised that BellSouth assumes no liability for loss of profit or revenues should an interruption of service occur.

Pathnet shall fully comply with all provisions of applicable law in carrying out its obligations hereunder but shall not be obliged under any circumstances whatsoever to obtain any of the permits, authorizations, licenses, consents or approvals to be obtained by Tri-State in the conduct of its business, or the use and operation by each Party of its rights in the System.
