Patent Certifications f C \1 "2"}. Each Party shall immediately give written notice to the other of any certification of which it becomes aware filed pursuant to 21 U.S.C. (S)355(b)(2)(A), or (S)355(j)(2)(A)(vii) (or any amendment or successor statute thereto) claiming that the CAT Patent Rights, CAT Collaboration Patent Rights, ELAN Collaboration Patent Rights, ELAN Patent Rights or Joint Collaboration Patent Rights covering any Collaboration Product are invalid or that infringement will not arise from the manufacture, use or sale of such Collaboration Product by a Third Party.
