The exception to Trading Partner Exchange Functions described herein shall not apply to the extent that Trading Partner receives PHI or Personally Identifiable Information from the Exchange that Trading Partner would not ordinarily gather in the process of determining eligibility for, or enrollment in, a health insurance plan.

Part 155 (“the Exchange Requirements”), promulgated pursuant to the Act.
