  • The sale of each Sold Asset shall be a separate transaction (each, a “Transaction”) and for each Transaction with respect to a Sold Asset that is of a type normally traded thereby, except as herein expressly provided, this Agreement shall constitute a “Confirmation” with respect to each Transaction and shall be governed by the Standard Terms and Conditions for Par/Near Par Trade Confirmations (the “LSTA Standard Terms and Conditions”) published by the Loan Syndication and Trading Association, Inc.

  • It is the intent of the parties hereto that the LSTA Par/Near Par Trade Confirmation and the LSTA Distressed Trade Confirmation are both being used for administrative convenience, and if the Company reasonably requests any amendment to this Agreement, any Schedule hereto or any other document in connection therewith (for accounting, regulatory or other reasons) the parties will, in good faith, use their commercially reasonable efforts to amend or modify any such documents as requested by the Company.

  • If any Other Priority Lien Secured Parties accept such offer, it shall be exercised pursuant to one or more Par/Near Par Trade Confirmations published by The Loan Syndications and Trading Association, Inc.

Related to Par Trade

  • Proprietary Marks shall have the meaning as set forth in Section 24.01.

  • Proprietary mark or “brand” means the mark or brand of a product which is owned by an industrial firm;

  • Contra Trade ’ means a trade or transaction which involves buying or selling any number of shares of the Company and within 6 months trading or transacting in an opposite transaction involving sell or buy following the prior transaction.”

  • Licensed Marks means those MLS GRID and MLS trademarks, service marks, word marks, logos and distinctive marks of all other kinds, if any, set out in Exhibit A as Licensed Marks.

  • Company Marks means the trademarks, trade names, service marks, logos, and/or service names of the Company.
