Panel Selection. The peer panel (herein referred to as “Panel”) shall consist of four certificated teachers and one administrator. 18.4.1 Teachers seeking a position on the Panel will submit a letter of interest to the faculty association. 18.4.2 The certificated members of the Panel shall be selected by majority vote of the certificated membership. 18.4.3 Certificated Panel members shall not be considered management under the Educational Employment Relations Act (EERA). 18.4.4 The administrative representative to the Panel shall be appointed by the superintendent and approved by the Board.

Hearing(s): Merits hearing took place from 28 March – 1 April 2022. 2 IRP is intended to hear and resolve Disputes for the following purposes: (i) ensure that ICANN does not exceed the scope of its Mission and otherwise complies with its Articles of Incorporation and Bylaws; (ii) empower the global Internet community and Claimants to enforce compliance with the Articles of Incorporation and Bylaws through meaningful, affordable and accessible expert review of Covered Actions (as defined in § 4.3(b)(i)); (iii) ensure that ICANN is accountable to the global Internet community and Claimants; (iv) address claims that ICANN has failed to enforce its rights under the IANA Naming Function Contract (as defined in Section 16.3(a)); (v) provide a mechanism by which direct customers of the IANA naming functions may seek resolution of PTI (as defined in Section 16.1) service complaints that are not resolved through mediation; (vi) reduce Disputes by creating precedent to guide and inform the Board, Officers (as defined in Section 15.1), Staff members, Supporting Organizations, Advisory Committees, and the global Internet community in connection with policy development and implementation; (vii) secure the accessible, transparent, efficient, consistent, coherent, and just resolution of Disputes; (viii) lead to binding, final resolutions consistent with international arbitration norms that are enforceable in any court with proper jurisdiction; and (ix) provide a mechanism for the resolution of Disputes, as an alternative to legal action in the civil courts of the United States or other jurisdictions. Examples of Panel Selection in a sentence

  • If this is not possible, the procedure established in Article 179 (Panel Selection) shall be followed, in which event the periods set out thereof shall be reduced by half (23).

  • If not possible, the procedure pursuant to Article 179 (Panel Selection) shall be followed to appoint a new Panel, in which event the periods set out thereof shall be reduced by half (22).

  • If the parties do not agree on the composition of the Panel by the time of the Initial Conference, or by any extension thereof agreed to by all parties and the Administrator, then the Panel Selection Process set forth in subparagraph C shall be followed.

  • The Administrator shall set the dates for exercising all strikes and shall complete the Panel Selection Process within fifteen (15) days of the Initial Conference.

  • The Panel Selection Process shall be completed no later than ten (10) days after the Initial Conference.

  • If the parties do not agree on the composition of the Panel by the time of the Initial Conference, or by any extension thereof agreed to by all parties and the Administrator, then the Panel Selection Process set forth in subparagraph D, below, shall be followed.

  • Where a Party claims that a dispute arises under this Chapter, Article 22.9 (Panel Selection) shall apply, except that, unless the Parties otherwise agree, the panel shall be composed entirely of panelists meeting the qualifications in paragraph 4 .

  • If any of the panelists dies, withdraws, is removed or is otherwise unavailable, that panelist shall be replaced by a panelist appointed pursuant to paragraph 5 of Article 12.9 (Panel Selection).

  • If not possible, the procedure pursuant to Article 179 (Panel Selection) shall be followed to appoint a new Panel, in which event the periods set out thereof shall be reduced by half22.

  • Each of the Parties shall pay for the services and expenses of its representatives, witnesses, and attorneys; all other costs incurred in connection with the arbitration shall be paid as follows: fifty percent by the Non-Concurring Party, with the Concurring Parties each bearing twenty-five percent of the costs; provided that if Alternate Arbitration Panel Selection is utilized such cost shall be paid as follows: (1/3 each) by MLMC, TVA and Choctaw.
