Pad Ready definition

Pad Ready means, with respect to the Commercial Project site and the Residential Project site, the completion by the Developer of the site improvements, utility extensions, relocations, repairs and/or replacement, and grading of a building pad plus or minus two (2) feet based on grades shown on the final development plan approved by the City and properly sloped and stabilized according to O.S.H.A. and K.D.H.E. standards, as applicable, as evidenced by the issuance by the City’s third-party City Engineer of a confirmation letter stating the aforementioned improvements have been completed and such site is sufficiently prepared for the eventual vertical construction of the applicable Commercial Project or the Residential Project, which confirmation letter shall not be unreasonably withheld or delayed.
