Overbuild definition

Overbuild means a cable system constructed to serve subscribers currently served by an existing cable system, including those parts of an existing system that will be constructed within six months pursuant to plans filed with the council.
Overbuild means the delivery of video programming services to subscribers served by the Seller through any means, including, but not limited to, cable television, multipoint distribution system ("MDS"), multichannel MDS, master antenna television system, satellite master antenna television system and multichannel microwave distribution system (each of which shall be referred to as an "Operator"). The mere fact that another Operator has video programming services distribution plant within areas in which Seller has subscribers will not be considered to be an Overbuild. Further any Overbuild by any Operator which is owned, managed or affiliated with Adelphia Communications Corporation, Olympus Communications, L. P., or Buyer shall not be an Overbuild for the purposes of this Agreement.
Overbuild means that portion of a cable system constructed to serve subscribers already served by an existing cable system.

  • BTE may aggregate in its forecast the anticipated requirements for Overbuild Products from BTE and its Affiliates, or each BTE Affiliate may submit a separate forecast.

  • The Parties further agree that any Equipment, Services or Software that is provided by Vendor at no cost to BTE for Procurement Documents submitted on or prior to March 10, 2006, shall not be included for purposes of determining the Overbuild Percentage or the Commitment.

  • For the avoidance of doubt, during the Exclusivity Period, the Sprint Entities shall not be permitted to transition Sprint Customers from the Alliances Network to any wireless network built by the Sprint Entities, directly or indirectly, in the Markets during the Overbuild Period.

  • Anacomp agrees to accept such Overbuild, which shall be invoiced in the same manner and at the same price as Converted Microfilm Products hereunder for which Firm Orders are in place and to use its best efforts to market such Overbuild in the same manner as prior to the Effective Date; provided, however, that Anacomp will not be obligated to accept more than 600,000 square feet of Overbuild in any calendar month (net of any returns of Overbuild accepted by SKC in such month).
