Ovation has the meaning set forth in Section 5.15(b).

Ovation shall automatically cease on the 90th day following the termination of this Agreement. The right to the name may also be withdrawn by you during the term of this Agreement upon 90 days’ written notice by you to the Trust. Nothing contained herein shall impair or diminish in any respect, your right to use the names “Symphony” and “Ovation” in the name of, or in connection with, any other business enterprises with which you are or may become associated. There is no charge to the Trust for the right to use this name.

• Students may take dual enrollment courses at PHSC, online through PHSC, or at their high school (Dayspring Academy’s Ovation campus).

• Ovation will store Client’s reproductive materials in accordance with Ovation’s procedures in the usual facilities maintained for that purpose until this Agreement is terminated in the manner provided in Section V below.

• Under no circumstances and legal theory, whether in tort, contract or otherwise, shall Ovation, its suppliers, successors or assignees, be liable to Client or Child born of the reproductive materials or any other person for any indirect, incidental, consequential or special damages whatsoever, arising out of the freezing, shipment, storage, or related services rendered by Ovation.

Ovation with respect to its activities relating to the Fund shall automatically cease on the ninetieth day following the termination of this Agreement. The right to the name may also be withdrawn by the Manager during the term of the Management Agreement upon ninety (90) days’ written notice by the Manager to the Trust and the Sub-Advisor. Nothing contained herein shall impair or diminish in any respect the Manager’s right to use the names “Symphony” and “Ovation” in the name of, or in connection with, any other business enterprises with which the Manager is or may become associated.
