OUTSTANDING LIABILITY AMOUNT definition

OUTSTANDING LIABILITY AMOUNT in relation to a Bond issued by a Bank, has the meaning given in the relevant Counter Indemnity;
OUTSTANDING LIABILITY AMOUNT in relation to any Letter of Credit or Bank Guarantee at any time means the amount stated therein to be the maximum amount for which the Issuing Bank or the Lenders (as the case may be) could be actually and/or contingently liable thereunder, less the aggregate of:
OUTSTANDING LIABILITY AMOUNT means, at any time, in respect of any Bond issued by the Issuing Bank and outstanding, the maximum amount of all liabilities (whether actual or contingent and whether presently payable or not) of the Issuing Bank under or in connection with such Bond and, for the avoidance of doubt, any liability of the Issuing Bank under or in connection with such Bond (whether or not discharged by the Issuing Bank) shall not be included in the calculation of the Outstanding Liability Amount for a Bond to the extent that the same has been reimbursed to the Issuing Bank by the Company in accordance with Clause 3 of this Agreement or discharged by way of set off in accordance with the terms and subject to the conditions set out in the Security over Cash Agreement.

OUTSTANDING LIABILITY AMOUNT means, at any time, in respect of any Bond issued by the Issuing Bank and outstanding, the maximum amount of all liabilities, (whether actual or contingent and whether presently payable or not) of the Issuing Bank under or in connection with such Bond and, for the avoidance of doubt, any liability of the Issuing Bank under or in connection with such Bond (whether or not discharged by the Issuing Bank) shall not be included in the calculation of the Outstanding Liability Amount for a Bond to the extent that the same has been reimbursed to the Issuing Bank by the Company in accordance with Clause 3 of this Agreement or discharged by way of set off in accordance with the terms and subject to the conditions set out in the Cash Collateral Agreement.
OUTSTANDING LIABILITY AMOUNT in relation to any Documentary Credit at any time means the maximum amount for which the LC Bank or the Banks, as the case may be, could be actually and/or contingently liable thereunder LESS the aggregate of (i) all amounts thereof repaid or prepaid hereunder and (ii) all amounts (if any) paid out by the LC Bank (or the Banks) thereunder for which the LC Bank and/or the Banks have been reimbursed by the Obligors (whether or not out of the proceeds of a Tranche 2 Advance).
OUTSTANDING LIABILITY AMOUNT means, at any time, in relation to any Letter of Credit, the amount stated in that Letter of Credit to be the maximum amount for which the Working Capital Bank could be actually or contingently liable less the aggregate of all amounts (if any) actually paid by the Working Capital Bank under the Letter of Credit for which the Working Capital Bank has been reimbursed by the Obligors as at that time.
OUTSTANDING LIABILITY AMOUNT in relation to any Documentary Credit at any time means the maximum amount for which the LC Bank or the Lenders, as the case may be, could be actually and/or contingently liable thereunder less the aggregate of (i) all amounts thereof repaid or prepaid under this Agreement and (ii) all amounts (if any) paid out by the LC Bank (or the Lenders) thereunder for which the LC Bank and/or the Lenders have been reimbursed by the Obligors (whether or not out of the proceeds of a Tranche D Advance).
OUTSTANDING LIABILITY AMOUNT means, in respect of a Letter of Credit at any time, the amount shown in that Letter of Credit as the maximum amount payable under it or if one or more drawings have been made under that Letter of Credit, the maximum amount capable of being drawn under that Letter of Credit at that time following such drawing or drawings provided that if a Letter of Credit has been returned and cancelled or the Financier is satisfied (acting reasonably) that no further liability exists under the Letter of Credit, the Outstanding Liability Amount of the Letter of Credit is nil.
OUTSTANDING LIABILITY AMOUNT in relation to any contingent liability under any Ancillary Facility, L/G or Documentary Credit at any time means the maximum amount for which the relevant Ancillary Bank, Issuing Bank or Documentary Credit Bank or the Lenders, as the case may be, could be actually and/or contingently liable thereunder less the aggregate of (i) all amounts thereof repaid or prepaid hereunder or thereunder and (ii) all amounts (if any) paid out by the relevant Ancillary Bank, Issuing Bank or Documentary Credit Bank (or the Lenders) thereunder for which the relevant Ancillary Bank, Issuing Bank or Documentary Credit Bank and/or the Lenders have been reimbursed by the Obligors (whether or not out of the proceeds of an Advance).
OUTSTANDING LIABILITY AMOUNT means in relation to an outstanding Xxxx, the full face amount thereof.
