Our Terms definition

Our Terms are the terms and conditions applicable to the supply by us to you of the Services and related equipment and consist of these General Terms, Service Specific Terms, Critical Information Summaries, pricing and fee schedules and the other documents referred to in the General Terms and the Service Specific Terms. Our Terms form our standard form of agreement formulated in accordance with section 479 of the Telecommunications Act.

  • Our Terms and Conditions shall also apply if, despite being aware of Clients’ conditions, which are contrary to or deviate from our Terms and Conditions or are not regulated in our Terms and Conditions, we provide services to Clients without reservation or if Clients refer to the application of their General Terms and Conditions in their enquiries or their orders.

  • Changes to these Terms: Our Terms of Service are available at the Company’s office, on the Company’s website or by email or U.S. Mail upon request.


More Definitions of Our Terms

Our Terms of Sale shall apply exclusively; we do not recognise contradictory terms and conditions of the customer or terms and conditions which deviate from our Terms of Sale, unless we had explicitly approved their validity in writing. Our Terms of Sale shall also apply if we carry out the delivery to the customer without reservation in the knowledge of contradictory terms and conditions of the customer or terms and conditions which deviate from our Terms of Sale.
Our Terms means these terms and conditions which may be amended from time to time.

Related to Our Terms

  • URL Terms means the terms with which Customer must comply, which are located at a URL, referenced in this Agreement and are hereby incorporated by reference.

  • Master Terms and Conditions (11/18) means the body of text from the preamble through the signature page of this Contract.

  • Standard Terms and Conditions or “Standard Terms” means these terms and conditions for the grant of the Loan to the Borrower by ABFL.

  • Use Terms means the Software Use Rights document as defined in the Order Form.

  • Same terms and conditions means that a carrier cannot apply

  • General Terms means these terms and conditions.

  • TERMS OF SALE IF YOU SUCCESSFULLY BID ON A PROPERTY, YOU WILL BE REQUIRED TO PAY THE ADVERTISED DEPOSIT WHICH MUST BE IN THE FORM OF CASH OR A CASHIER’S CHECK MADE PAYABLE TO YOURSELF. THIS IS A CASH SALE AND IS NOT CONTINGENT UPON THE BUYER’S ABILITY TO OBTAIN FINANCING. XXXXXXX MONEY IS NOT CONSIDERED AN “OPTION” PAYMENT. The successful bidder for each property shall execute an “auction real estate sales contract” for each property immediately after being declared the successful bidder by the auctioneer. Copies of this sales contract are available for review on website (xxx.XxxxxxxXxxxxxx.xxx) Bidding increments are made in amounts acceptable to the Auctioneer, who may set a minimum bidding increment as the sale progresses. Any bid may be rejected by the Auctioneer if it is merely nominal or, at his or her discretion, it may negatively affect the auction process. Auctions will be either Absolute or Reserve. If this is an Absolute Sale, the high bidder shall be the Purchaser. If this is a Reserve sale the seller may accept or reject the high bidder, however; if the bid exceeds the predetermined Reserve Price the auction will become an Absolute auction and will be sold to the high bidder. In the event of a dispute between bidders the Auctioneer in its discretion may determine the successful bidder or re-offer the property for sale. By bidding at an auction, whether present or by agent, by written bid or otherwise, bidders shall be deemed to have consented to the jurisdiction of the State and Federal courts of the State of Maryland. If property is tenant occupied, the property will be sold subject to the existing tenant in dwelling. Broker Participation Invited: A 2.5% buyer broker commission, before the inclusion of the Buyer’s Premium, will be paid to brokers who represent a purchaser on any auction property. The Buyer’s Premium is based on only the Bid Price of each auction sale. In order to be paid a commission, the buyer broker must do the following: ►Register clients at least 48 hours prior to auction on xxx.XxxxxxxXxxxxxx.xxx ►Accompany client to auction sale ►Review the “terms and conditions of sale” with each client you represent Each step must be completed. If any of these steps have been omitted, the broker will not be paid a commission. There will be no exceptions. Bidders will be required to acknowledge buyer broker relationship as they register at the sale. By bidding, each bidder and buyer broker agree to indemnify and hold harmless seller and auctioneer for any and all claims for compensation made by any person or entity in connection with the auction. TITLE: All properties will be sold with free and clear title. All properties are being sold subject to any ground rent of record. In the event there is an error in the advertised ground rent or the contract states “Fee Simple”, the Buyer shall take title with the existing ground rent of record and there shall not be a monetary penalty to the seller. SAMPLE In the event, there is an error regarding fee simple or ground rent in the chain of title including deeds, the Buyer shall take title with the existing ground rent of record and there shall not be a monetary penalty to the seller. In event of a ground rent escrow, the title company or settlement company agrees not to charge an escrow holding fee to the seller. If the Trustee/ Seller is unable to convey good and marketable title, the purchaser's sole remedy in law or equity shall be limited to the refund of the deposit. Upon refund of the deposit this sale shall be null and void and of no effect, and the purchaser shall have no further claim against the Trustee/ Seller or Auctioneers.

  • Specific Terms and Conditions means the specific terms and conditions as described in section 6.1 (and, in relation to an Agreement between Envestra and a Network User, means the Specific Terms and Conditions which form part of that Agreement).

  • Key Terms means, with respect to a Relevant Transaction and a party, the valuation of such Relevant Transaction and such other details the relevant party deems relevant from time to time which may include the effective date, the scheduled maturity date, any payment or settlement dates, the notional value of the contract and currency of the Relevant Transaction, the underlying instrument, the position of the counterparties, the business day convention and any relevant fixed or floating rates of the Relevant Transaction. For the avoidance of doubt, "Key Terms" does not include details of the calculations or methodologies underlying any term.

  • General Terms and Conditions means the General Terms and Conditions for Services Contracts as referenced on the RFP cover page.

  • Additional Terms and Conditions means the terms and conditions that govern the promotion as determined by the Participating Banks (if any).

  • Primary Terms and Conditions means the terms and conditions applicable to the ICICI Bank’s internet banking facility/service.

  • Other Definitional Provisions set forth in Section 1.2 of the Basic Servicing Agreement are incorporated by reference into this 2017-3 Servicing Supplement.

  • Terms of Reference (TOR) means the document included in the RFP as Section 5 which explains the objectives, scope of work, activities, tasks to be performed, respective responsibilities of the Client and the Consultant, and expected results and deliverables of the assignment.

  • Standard Terms means the document titled ‘Service Agreement - Standard Terms’ version 1.1, published on the website at xxxx://xxx.xxx.xxx.xxx.xx or such other website as We may from time to time notify You, as updated or replaced from time to time in accordance with clause 1.2(d)

  • Special Terms and Conditions means any attachment hereto entitled, in whole or in part, “Special Terms and Conditions.”

  • Standard Terms of Supply means the standard terms and conditions for Call-off Contracts set out in Schedule 5.

  • Product Terms means the document that provides information about Microsoft Products and Professional Services available through volume licensing. The Product Terms document is published on the Licensing Site and is updated from time to time.

  • Basic Terms Modification means any proposal:

  • Agreed Terms means, in relation to a document, such document in the terms agreed between the Seller and the Purchaser and signed for identification by the Purchaser and the Seller with such alterations as may be agreed in writing between the Seller and the Purchaser from time to time;

  • Commercial Terms means this Agreement excluding the Purchase Order;

  • Additional Terms means any additional terms agreed in writing amending, varying or agreeing additions to these Terms;

  • Specific Terms in relation to a Loan means the specific terms applicable to that Loan as set out in the document entitled ‘Specific Terms’ related to that Loan;
