Section 4 (1) of the OUR Act sets out the functions of the Office.
REGULATION7.1 The Licensee in carrying out the Licensed Business shall be subject to regulation by the Office pursuant to the OUR Act, the ELA and any statutory modification, consolidation or re-enactment thereto and any other applicable legislation and all regulations and rules made pursuant thereto.
In 2015 both the Electricity Act (EA) and the OUR Act of 1995, as amended, were rewritten and substantially amended.
A “specified service” is defined in section 2 of the Act to mean, inter alia, a telecommunications service, while a “prescribed utility service” is defined in section 2 and the First Schedule of the OUR Act to include the provision of telecommunications services.
The OUR is a multi-sector regulatory agency which was established in 1995 by the Office of Utilities Regulation Act (the OUR Act) from which it derives its mandate to regulate the provision of certain utility services in Jamaica.
As part of its overall functions to regulate specified services and facilities under section 4(1) of the Act, and in keeping with its express power to determine the rates which may be charged in respect of the provision of a prescribed utility service under section 4(4) of the Office of Utilities Regulation Act ("the OUR Act"), the OUR is authorised to determine the prices charged by telecommunications operators for the provision of services.

With regard to the electricity sector, the OUR Act, Electricity Licence, 2016 and Electricity Act, 2015 are the legislative instruments governing the sector.
The OUR will regulate in accordance with the OUR Act, taking into account these policy objectives.
Under the OUR Act licences are granted by the responsible Minister on the recommendation of the Office.
