Other Exclusions definition

Other Exclusions. This warranty shall not cover any condition attributable to: (1) improper installation of the Product and/or failure to abide by RENEW’s installation guidelines, including but not limited to improper gapping; (2) use of the Product beyond normal use or service conditions, or in an application not recommended by RENEW’s guidelines and local building codes; (3) movement, distortion, collapse or settling of the ground or the supporting structure on which the Product is installed; (4) any act of God (such as flooding, hurricane, earthquake, lightning, etc.); (5) improper handling, storage, abuse or neglect of the Product by Purchaser, the transferee or third parties; or (6) ordinary wear and tear.
Other Exclusions. The Uptime calculation excludes downtime that results from: • Events beyond our reasonable control (force majeure), including natural disasters, power failures, or third-party attacks (e.g., DDoS). • Issues with your internet service provider (ISP) or external network. • Your or your users’ misuse, custom scripts, software or coding errors, security misconfigurations, or any breach of this Agreement. • Suspension or termination of your account in accordance with our Terms of Service.

Examples of Other Exclusions in a sentence

  • No payment will be made for expenses incurred for: Medical or surgical treatment of the eye; Lenses which are not medically necessary and are not prescribed by an Optometrist or Ophthalmologist, or frames for such lenses; Care not listed in The Schedule; Other Exclusions and Limitations listed in this Policy.

  • Available means a period when all or the material majority of the Cloudfy Services are operational; the Cloudfy Services are unavailable if they are unable to load outside of Scheduled Maintenance and Other Exclusions.

  • Uptime Percentage means the proportion of scheduled Availability time (that is, any time on a 24 hour per day, 7 days per week basis, excluding Scheduled Maintenance and Other Exclusions (each as defined below)) during any one calendar month when the Cloudfy Services are Available.

More Definitions of Other Exclusions

Other Exclusions means (i) reasons beyond Algosec’s reasonable control, including but not limited to, the availability of 3rd party services incorporated into or working in conjunction with the SaaS solution, events of Force Majeure and any other factor beyond Algosec’s reasonable control, (ii) Downtime due to Customer’s software or hardware or third party software or hardware used by the Customer its agents or contractors, or both; (iii) abuses or other behaviors that violate the ▇▇▇▇; (iv) Customer’s use of the Subscription inconsistent with the Documentation, including but not limited to unauthorized users.

  • Lower explosive limit (LEL) means the concentration of a compound in air below which a flame will not propagate if the mixture is ignited.

  • CABS means the Carrier Access Billing System.

  • Explosives (1) means solid, liquid or gaseous substances or mixtures of substances which, in their application as primary, booster, or main charges in warheads, demolition and other applications, are required to detonate.

  • Malicious Code means viruses, worms, time bombs, Trojan horses and other harmful or malicious code, files, scripts, agents or programs.
