Original Shipper definition

Original Shipper has the meaning assigned to it in the preamble to the Contract, and its authorized heirs and assignees as set forth in Section 6.1
Original Shipper means the first shipper who distributes or sells or offers for sale shellfish to another shipper, reshipper, retailer or ultimate consumer after the harvest of such shellfish or after the purchase of such shellfish from a harvester.
Original Shipper means a shipper that originally contracted with Northwest for firm capacity at the Maximum Base Tariff Rate listed in the Tariff and does not include any Replacement Shipper. 9 Any fraction of a percent shall be rounded to the nearest one-tenth percent and the difference between the dollar amounts reflected in Appendix D shall be interpolated accordingly. (a) the dollar amount shown in Appendix D for the Increased Tax Rate10 multiplied by (b) the number of years and/or partial years (prorated monthly) during the Settlement Term that the Increased Tax Rate is in effect. Northwest shall amortize through rates the balance of the regulatory asset account over a period of five (5) years beginning with the effective date of the rates established through Northwest’s next NGA section 4 or 5 general rate case filing or pre-filing settlement. Any costs recorded in such regulatory asset may accumulate interest at the Commission’s rate in accordance with 18 C.F.R. § 154.501(d) from the date incurred until Northwest fully recovers the costs through its rates. Section 6.3 If the current U.S. federal income tax rate applicable to corporations of 21% should decrease for any taxable period during the Settlement Term, then the terms and provisions of this Article VI shall continue in effect beyond the Settlement Term until all refunds under Section 6.1 have been made. If the current U.S. federal income tax rate applicable to corporations of 21% should increase for any taxable period during the Settlement Term, then the terms and provisions of this Article VI shall continue in effect beyond the Settlement Term until the five-year amortization period is complete.

  • In the case of segmentation through release, the Original Shipper may segment by nomination any portion of the capacity it retains to the extent operationally feasible and the Replacement Shipper may segment by nomination any portion of the capacity it obtains in the release to the extent operationally feasible.

  • The Original Shipper shall nominate the quantities of Oil, shall deliver such nominated quantities, using a daily average on a monthly basis, at the Entry Points and shall withdraw them at the Exit Points, in accordance with the provisions of this Contract and the Carrier Manual.

  • Such guarantee shall be in an amount equal to the product of the Tariff then in effect for all the Segments and Coveñas Terminal multiplied by the Contracted Capacity of such Original Shipper for one month.

  • Affiliates of the Original Shipper shall have the right to nominate and to utilize the Contracted Capacity of the Original Shipper, in which case their relationship with the Carrier shall be governed by this Contract.
