Operation Certificate definition

Operation Certificate means the operation certificate issued in accordance with N.J.S.A. 5:12-96(a) by the Division upon a determination by the Director of the Division that the Casino and, if applicable, a simulcasting facility, complies in all respects with the requirements of the Act, and that the Casino and any applicable simulcasting facility are prepared in all respects to receive and entertain the public.

Examples of Operation Certificate in a sentence

  • If the Buyer provides timely notice that it disputes such Commercial Operation Certificate, the Seller shall either (i) at its sole cost and expense, immediately correct and/or remedy the defects, deficiencies and other conditions so as to achieve Commercial Operation, or (ii) request that the matter be submitted to the dispute resolution procedures set forth in Article 32.

  • If the Buyer agrees with such Commercial Operation Certificate and the Punch List, the Buyer shall promptly countersign such Commercial Operation Certificate.

  • If the Buyer does not countersign or object to any such Commercial Operation Certificate and/or Punch List within twenty (20) days after receipt, such Commercial Operation Certificate and/or Punch List shall be deemed confirmed and agreed to by the Buyer on the date that such Commercial Operation Certificate and/or Punch List was originally delivered to the Buyer.

  • Seller and the Licensed Professional Engineer must complete and submit the Commercial Operation Certificate attached hereto as Appendix C to PSE when the Facility has achieved Commercial Operation.

  • Should Owner not respond as required in writing within ten (10) days of its receipt of GEC’s Commercial Operation Certificate, Commercial Operation shall be deemed to have occurred.

  • The SPV shall not amend, modify, or supplement the First Tier Agreement or waive any provision thereof, in each case except with the prior written consent of each Agent; nor shall the SPV take, or permit the Originator to take, any other action under the First Tier Agreement that could have a Material Adverse Effect on any Agent or any Investor or which is inconsistent with the terms of this Agreement.

  • If Seller has not actually achieved Commercial Operation, Seller must promptly resolve any issues or deficiencies with respect to Commercial Operation and resubmit the Commercial Operation Certificate.

  • In the event the Electricity Act 2005 is proclaimed by the President of the Republic of Mauritius before the SCOD, CEB shall issue a Commercial Operation Certificate to Seller stating the date of the commercial operation of the Project (“Commercial Operation Date” or “COD”) which shall be the Business Day following the issuance of the Completion Certificate.

  • Should GEC not respond as required in writing within ten (10) days of its receipt of Contractor’s Commercial Operation Certificate, Commercial Operation shall be deemed to have occurred.
