Ongoing Litigation definition

Ongoing Litigation means the following litigation: (i) in the Circuit Court of ▇▇▇▇ County, Illinois, entitled iPCS Wireless, Inc. v. Sprint Corporation, WirelessCo L.P., Sprint Spectrum L.P., SprintCom, Inc. and Sprint Communications Company, L.P. (Case ▇▇. ▇▇ ▇▇ ▇▇▇▇▇), which is currently on appeal in the Illinois Appellate Court for the First District and (ii) in the Court of Chancery of the State of Delaware (the "Delaware Court") entitled Horizon Personal Communications, Inc. and Bright Personal Communications Services, LLC v. Sprint Corporation, Wirelessco L.P., Sprint Spectrum L.P., SprintCom, Inc., Sprint Communications Company L.P., Nextel Communications, Inc., Phillieco L.P. and APC PCS LLC (C.A. No. 1518-N).
Ongoing Litigation means (a) any litigation ongoing as of the Effective Date that was brought against Alnylam regarding or relating to any Alnylam Technology or (b) all related or similar actions arising from substantially the same underlying facts as any litigation described in clause (a), whether brought prior to, on or after the Effective Date.

  • Since May 17, 2004 through the date of this Agreement, (i) no amount has been paid by or on behalf of GTFM or any GTFM Subsidiary to De Teresa other than for Ongoing Litigation Matters, and (ii) the amounts paid or payable for the Ongoing Litigation Matters have not exceeded the amount set forth in Section 5.7(d) of the Seller Disclosure Schedule.
