One Court Square Mortgage Loan. With respect to the One Court Square Loan Combination, the Mortgage Loan included in the Trust, which is (i) secured by the Mortgaged Property identified on the Mortgage Loan Schedule as One Court Square, (ii) evidenced by a promissory note A-5 and (iii) pari passu in right of payment with the One Court Square Companion Loans to the extent set forth in the related Loan Documents and as provided in the One Court Square Co-Lender Agreement. The One Court Square Trust REMIC Regular Interests, as to which the One Court Square promissory note A-5 corresponds, which is included in the Trust, will also be assets of the Trust, and for tax reporting purposes, any references herein to the “One Court Square Mortgage Loan” (and, insofar as they mean or include the One Court Square Mortgage Loan, any references to “Mortgage Loan” and “Mortgage Loans”) will be deemed to be references to the One Court Square Trust REMIC Regular Interests.
