O&M Works means all the Works identified in Section 3 (O&M Works) of the Employer’s

• The Parties shall use their reasonable endeavours to agree any revisions to the drawings set out in Appendix 0/4 of Part 5 of Schedule 4 (O&M Works Requirements) necessary to reflect such exclusion and if they are unable to reach agreement within 60 Business Days of the effective date of such exercise then either Party may refer the matter for resolution under the Dispute Resolution Procedure.

• The Access Rights over those parts of the New Works Site and the O&M Works Site shown cross-hatched in dark blue including the dark blue line shall be restricted to servitude rights or wayleaves for the purposes of construction and maintenance of drainage works and associated works only.

• The Access Rights over those parts of the New Works Site and the O&M Works Site shown shaded in purple including the purple line shall be restricted to servitude rights or wayleaves for the purposes of grouting of the sub-surface only.

• VIA agrees to provide the City consents and authorizations as may be required to access the CN-CP Railway Corridor Lands and/or the VIA Railway Tracks in connection with the O&M Works.

More Definitions of O&M Works

O&M Works or “O&M” shall mean the works relating the operation and maintenance of the Project during the O&M Period, as more particularly described in SCHEDULE III and SCHEDULE-IV.
