  • You agree that exclusive jurisdiction and venue of any action with respect to this Agreement shall be in a court of competent jurisdiction located in Los Angeles, California and that You hereby submit to the jurisdiction and venue of such courts for the purpose of any such action.

  • Any references to “ETA” in this MOU mean OFLC, only and no other agency or sub-agency component of DOL.

  • The employer agrees that it will offer, advertise in its recruitment, and pay at least the Adverse Effect Wage Rate (AEWR); a prevailing wage rate, if the OFLC Administrator has approved a prevailing wage survey for the applicable crop activity or agricultural activity and, if applicable, a distinct work task or tasks performed in that activity; the agreed-upon collective bargaining rate, the Federal minimum wage, the State minimum wage, or any other wage rate it intends to pay, whichever is highest.
