ODRO definition

ODRO. A domestic relations order which the Administrator has determined to be a qualified domestic relations order within the meaning of Code section 414(p).

Examples of ODRO in a sentence

  • As provided by Code section 401(a)(13) and to the extent not otherwise required by law, no benefit provided by the Plan may be anticipated, assigned or alienated, except to create, assign or recognize a right to any benefit with respect to a Participant pursuant to a ODRO, or to use Participant's vested Account Balance as security for a loan from the Plan, pursuant to Code section 4975.

  • If a ODRO specifies that the Alternate Payee is entitled to any portion of the Account of a Participant who has an outstanding loan balance, all outstanding loans shall generally continue to be held in the Participant's Account and shall not be divided between the Participant's and Alternate ▇▇▇▇▇'s Accounts.

  • Such suspension may continue for a reasonable period of time (as determined by the Administrator) which may include the period of time the Administrator, a court of competent jurisdiction or other appropriate person is determining whether the domestic relations order qualifies as a ODRO.

  • A separate Account shall be established for an Alternate Payee entitled to any portion of a Participant's Account under a ODRO as of the date and in accordance with the directions specified in the ODRO.

  • The Employee, the Employee's spouse, or the Employee's spouse or former spouse, who is the alternate payee under a ODRO ("Distributee"), may elect to have any portion of an eligible rollover distribution paid directly to an eligible retirement plan.

  • In addition, a separate Account may be established during the period of time the Administrator, a court of competent jurisdiction or other appropriate person is determining whether a domestic relations order qualifies as a ODRO.

  • If a ODRO so provides, the portion of a Participant's Account payable to an Alternate Payee may be distributed, in a form permissible under Section 11, to the Alternate Payee at any time beginning as soon as practicable after the ODRO determination is made, regardless of whether the Participant is entitled to a distribution from the Plan at such time.
