Objectionable Activities definition

Objectionable Activities means, with respect to the Services, any one (1) or more of the following activities that is knowingly caused, controlled, encouraged, induced or facilitated by Company or its affiliates: • facilitating and/or promoting illegal activity, • depicting sexually explicit images, • promoting violence, • promoting unlawful discrimination, • incorporating any materials or functionality primarily intended to infringe or assist others in infringing upon any intellectual property rights, provided that infrequent incorporation of particular materials which result in unintended, unconnected infringements shall not be deemed an Objectionable Activity hereunder), • engaging in the endorsement of political positions or political candidates, or engaging in the sale or advertisement of tobacco, firearms, pornography, or religious causes, as Label deems in its sole, reasonable discretion to be objectionable, but for the avoidance of doubt shall exclude integration of the Services into (or access to any part thereof via) widgets/iframes into third party websites hosting or otherwise incorporating user contributed materials, provided such websites maintain and enforce a policy against uploading infringing or otherwise unlawful content. Notwithstanding the foregoing, at all times, the availability via the Services of recordings, videos and other content provided by or on behalf of SME hereunder or by any other Record Labels, including any Other Party, shall not be deemed Objectionable Activities; **** Confidential portion omitted and filed separately with the Securities and Exchange Commission pursuant to a request for confidential treatment.
Objectionable Activities means any one (1) or more of the following activities: the incorporation, facilitation, inducement, advocacy or promotion of illegal activity including without limitation infringement of copyright, trademark, patent or other intellectual property rights; the depiction or display of sexually explicit images; the promotion of violence; the promotion of discrimination; the endorsement of political positions or political candidates; and the advertisement, sale or promotion of tobacco, firearms, personal hygiene products, pornography, religious causes or any other subject matter which SONY BMG deems in its sole, unrestricted discretion to be objectionable.

  • Unprofessional conduct means the same as that term is defined in Sections 58-1-501 and 58-17b-502 and may be further defined by rule.

  • Reasonable grounds means that a reasonable person in your position would also suspect the information indicates misconduct or a breach of the law.
