Objecting definition

Objecting means staying in the class, but telling the Court that you do not like something about the Settlement. “Excluding” yourself tells the Court that you do not want to be part of the Class or the Settlement. If you exclude yourself, you cannot object.

Examples of Objecting in a sentence

  • The cost of the First Appraiser shall be borne by the Objecting Party.

  • The cost of the Final Appraiser shall be borne equally by the Partnership and the Objecting Party.

  • Notwithstanding the procedure set forth above, the Partnership and an Objecting Party may, prior to or at any time during the appraisal process, mutually agree on a single Independent Appraiser to determine the Purchase Price, which determination shall be binding on all of the parties, or may agree in writing upon a Purchase Price.

  • All or any part of outstanding Eurocurrency Loans and ABR Loans denominated in Dollars may be converted as provided herein, provided that no Loan may be converted into a Eurocurrency Loan after the date that is one month prior to (i) in the case of a Loan made by an Objecting Bank, such Objecting Bank’s Commitment Expiration Date, and (ii) in the case of all Loans, the Termination Date.

  • Upon Court order, the Parties will have the right to obtain document discovery from and take depositions of any Objecting Class Member on topics relevant to the Objection.
