Examples of NZHF in a sentence
It has the power to enter into, deliver and perform, and has taken all necessary action to authorise its entry into, delivery and performance of, the LCHA, the other LCHA Documents and (where relevant) the NZHF Grant Funding Agreement (including the obligations of it and/or the Producer, and the transactions contemplated by or provided for by the LCHA, the other LCHA Documents and (where relevant) the NZHF Grant Funding Agreement).
BEIS is also considering including a Termination Event where: (f) if applicable, the Producer's NZHF GFA is terminated due to Producer breach or default (as ▇▇▇▇▇ the ICCC HoTs).
No Default with respect to it or the Producer has occurred and is continuing or might reasonably be expected to result from its or the Producer's entry into or performance of the LCHA, any of the other LCHA Documents or (where relevant) the NZHF Grant Funding Agreement.
Such exemptions to the no subsidy cumulation position will include: (i) NZHF funding; (ii) Renewable Transport Fuel Certificates (as discussed in item 6.6 (LCHA and RTFO Scheme Dual Participation Undertakings); and (iii) any Approved Scheme of Funding.
The obligations expressed to be assumed by it (and by the Producer) pursuant to the LCHA, the other LCHA Documents and (where relevant) the NZHF Grant Funding Agreement are legal, valid, binding and enforceable subject only to the Legal Reservations.
