Authorization for DB Contractor to proceed with Work under this Contract shall be provided through TxDOT’s issuance of NTP1 and NTP2 as set forth in Section 8.1 of the General Conditions, except to the extent that any additional or optional Notices to Proceed or differing conditions to NTP1 or NTP2 are set forth below.
Issuance of NTP1 authorizes Developer to perform (or, continue performance of) the portion of the Work necessary to obtain TxDOT’s approval of the component parts, plans and documentation of the Project Management Plan that are labeled “A” in the column titled “Required By” in Attachment 2-1 to the Technical Provisions.
On or about the fifth Business Day of each month following NTP1 and continuing through the last date of the Maximum Payment Schedule shown on Exhibit 5, Developer shall deliver to TxDOT five copies of a Draw Request in the form attached hereto as Exhibit 15 and meeting all requirements specified herein except as otherwise approved in writing by TxDOT.

As soon as possible after issuance of Maintenance NTP1, TxDOT and Maintenance Contractor shall jointly select a third-party facilitator to conduct the partnering meetings.
Contractor shall submit the Maintenance Management Plan (MMP) to TxDOT for review and approval in its discretion no later than 60 days after issuance of Maintenance NTP1.
Maintenance Contractor shall submit the documentation required under TxDOT’s DBE program within 90 days following issuance of the Maintenance NTP1.
Immediately following the issue of Maintenance NTP1, DB Contractor and TxDOT shall jointly perform a pre-condition inspection.
If TxDOT does not issue NTP2 before the later of the 271st day after the Proposal Due Date or the 91st day following the issuance of NTP1, solely due to a delay in issuance of the NEPA Approval, the Price shall be subject to adjustment, as described in this Section 12.1.6.
DB Contractor and TxDOT shall enter into a Change Order to revise the Maximum Payment Schedule and increase the NTP1 Payment Amount, as necessary, to account for the additional Work authorized.
