  • With respect to Buyer's development of the ----------------- Property, Buyer shall, at Buyer's sole cost and expense, apply for and obtain all licenses, permits, approvals and the like from the Town, SFWMD, NPBCID, the Florida Department of Environmental Protection and any other federal, state or local governmental agency or authority having jurisdiction over the Property necessary or desirable to permit Buyer to construct and operate its permitted use (collectively, the "Buyer's Approvals").

  • Buyer acknowledges that Abacoa and NPBCID are currently working on an agreement with the County dealing with the collection and disbursement of road impact fees based on the road impact fee credit that will be available to Abacoa as a result of the road improvements constructed by NPBCID ("Collection Agreement").

  • Prior to NPBCID incurring an obligation that will require a Co-Permittee to pay unexpected additional costs and expenses exceeding the amount held in the Reserve Fund Contingency, NPBCID shall notify the affected Co-Permittee(s) and the Steering Committee of the nature of the event and the amount of the unexpected additional cost and expense.

  • A quarterly budget accounting report shall be prepared by NPBCID.

  • Buyer acknowledges that a maintenance agreement for the maintenance of the preserve areas, streets, drainage and landscaping or any other items deemed appropriate by the Master POA or the Project POA may be entered into by the Master POA or the Project POA with NPBCID or other governmental agencies, and that a portion or all of the expenses referred to in such agreements may be assessed to the Property as a common expense.

  • System plans shall cover surface water drainage throughout Baywinds, including but not limited to regular and storm drainage or dedicated streets and other rights of way, lake drainage, and such other requirements as may be imposed by the SFWMD and NPBCID.

  • NPBCID will be issuing one (1) invoice to each Co-Permittee for its annual Funding Year payment amount, following which the Co-Permittee shall then have thirty (30) days from the date of receipt of the invoice within which to select one of the three (3) payment options and to make its initial payment in accordance with the option so selected.
