Notional Rate definition

Notional Rate means the agreed amount, which shall be paid as compensation to the Insured per unit deviation in Weather Index (To be specified for each Policy under section “Coverage Details”, in Schedule)
Notional Rate means for the year in which the relevant income was allocated to the General Partner (or, in the case of a tax imposed on a Distribution, the year in which such Distribution was made), the sum of (i) the highest marginal income tax rate for an individual resident in San Francisco, California (as well as non-income taxes, including taxes imposed under Section 1411 of the Code), taking into account the character of income received (as modified by Section 1061 of the Code or any successor or analogous provision), carryforwards of losses allocated to the General Partner in respect of Performance Participation Allocation, if any, the deductibility of state and local income taxes for U.S. federal income tax purposes in the tax year in which such payment is made and any applicable limitations on deductibility (and without regard to any capped deductions) and (ii) without duplication, any entity-level tax or governmental charge imposed on the General Partner and its direct and indirect owners; provided, that (i) for purposes of this definition (as well as the computations for which this defined term is used), the General Partner shall be assumed to have no items of income, gain, loss, deductions or credits other than those that are attributable to its General Partnership Interest (and that are not attributable to its Subscriptions) and (ii) in the case of a distribution of an asset other than cash to the General Partner that would not result in full taxation for an individual resident in San Francisco, California, the tax shall be assumed to be the tax that would apply under this definition if such asset had been sold by the Partnership for cash at the time of the distribution, the income had been allocated under paragraph 4.05 and the cash had been distributed.

Notional Rate means a notional interest rate of 9.0766%, nominal annual compounded daily in arrears, based on a notional 365 day year and calculated from the day following the A effective date to the relevant date, both such dates inclusive;
