Not substantially different from the market value means not more than 20 per cent variance from the market value.   • substantial owners means any individuals entitled to more than 10% of the profits of or with an interest of more than 10% in an entity either directly or indirectly.

For purposes of this definition, the value of the repairs or improvements means the Development Cost.
