NonStop Software definition

NonStop Software means all software and any revisions to such software provided by Contractor for use on a NonStop Designated System, in object code only. NonStop Software includes user documentation and related materials, but excludes documentation made publicly accessible by Contractor and software provided with an electronic license (such as a click-wrap license) or other license form provided by Contractor or its suppliers for particular NonStop Software. For purposes of the license grant only, the term NonStop Software also includes Proprietary Service Tools designated for use with other NonStop Software.
NonStop Software means all Software provided by HPE for Use on a Designated System. NonStop Software includes user documentation and related materials, but excludes documentation made publicly accessible by Hewlett Packard and Software provided by HPE with an electronic or other license form.

Examples of NonStop Software in a sentence

  • The initial Term will begin the first day of the second month following the shipment date of applicable NonStop Software.

  • NonStop Software added to a Designated System on a term basis during an Existing Term will be coterminous with the expiration date of the Existing Term and the corresponding TLC will be pro-rated for the remainder of the Existing Term.

  • NonStop Software available under a “per CPU” or “per processor” license must be licensed on each processor in the Designated System.

  • Any NonStop Software license will terminate (i) in the event of a change in either the System number or System type, or (ii) if the Designated System ceases to be within the possession or control of Customer.

  • Notwithstanding any contrary term in the Agreement, NonStop Software licenses are for use only on the Designated System and are non-transferable.

  • HPE grants Customer a license to use the applicable NonStop Software on a Designated System for the term specified on the Order (the “Term”).

Related to NonStop Software

  • SAP Software means: (i) any and all software products and Cloud Services licensed to Customer under the License Agreement as specified in software order forms or Cloud Service Order Forms (or other order forms, schedules or appendices as applicable) thereto; (ii) any new releases, updates or versions thereof made available through unrestricted shipment pursuant to the respective support agreement or warranty obligation and (iii) any complete or partial copies of any of the foregoing.

  • Licensed Software includes error corrections, upgrades, enhancements or new releases, and any deliverables due under a maintenance or service contract (e.g., patches, fixes, PTFs, programs, code or data conversion, or custom programming).

  • System Software means machine-readable data and executable programs used to define the functionality of the HPS control system and standard hardware products, but does not include firmware, operating system, application software or other software products.

  • Embedded Software means one or more software applications which permanently reside on a computing device.

  • Custom Software means Software identified as such in Appendix 4 of the Contract Agreement and such other Software as the parties may agree in writing to be Custom Software.
