Nonconforming Services means only the following: (i) Services are different than identified in the Contract; (ii) Services do not conform in all respects to Supplier’s specifications therefor, as in effect on the date of the Contract or, to the extent applicable, to applicable specifications, drawings, designs, samples or other requirements specified by Everspin;

Examples of Nonconforming Services in a sentence

  • Non-conforming Services may be rejected by City and in such case must be replaced by Contractor without delay at no cost to City.

  • In case Seller delivers to Buyer Non- conforming Goods or Non-conforming Services, Seller shall, at Buyer’s option and at Seller’s risk and expense, without undue delay repair or replace the Non-conforming Goods or refund to Buyer the price of the Non-conforming Goods, including all additional costs paid by Buyer, for instance freight and taxes.

  • Customer’s exclusive remedies for Nonconforming Rented Equipment or Nonconforming Services shall be as follows: (a) DECA shall replace the Nonconforming Rented Equipment and the Nonconforming Services within a reasonable time and at DECA’s sole expense.

  • Remedies for Nonconforming Services The Provider shall ensure that all goods and/or services provided under this Agreement are delivered timely, completely and commensurate with required standards of quality.
