Nonappropriation definition

Nonappropriation means the failure by the Iowa General Assembly or the Governor of the State of Iowa (“Governor”) to grant authority or to appropriate or approve the appropriation of funds sufficient to enable Lessee to pay any Lease Payment under this Lease Agreement or to enable Lessee to meet or perform any other obligations it may have under this Lease Agreement. Nonappropriation shall also include any circumstance in which any funds needed or required to enable Lessee to pay any Lease Payments under this Lease Agreement or to meet or perform any other obligation of Lessee under this Lease are: (i) lawfully de-appropriated or reduced, (ii) not allocated or allotted, or (iii) otherwise insufficient or not legally available.
Nonappropriation. The New Mexico Legislature or the New Mexico Public School Capital Outlay Council fails to grant sufficient money or appropriations to the Lessee to carry out the terms and conditions of this Lease.
Nonappropriation. The failure of the governing body of any Obligor to appropriate funds sufficient for such Obligor to make all or any portion of the Scheduled Payments pursuant to the related Contract as provided in such Contract.

Examples of Nonappropriation in a sentence

  • Non-appropriation or non-funding shall not be considered an event of default.

  • Nonappropriation of Funds: Seattle may terminate this Contract at any time without notice due to nonappropriation of funds, whether such funds are local, state or federal grants, and no such notice shall be required notwithstanding any notice requirements that may be agreed upon for other causes of termination.
