Non-prescriptive means the opposite of prescriptive. Therefore, ‘non-prescriptive’ transfer pricing tax legislation refers to legislation with no provisions on how to transact at arm’s-length price, that is legislation that is not direct or explicit on how to transact at arm’s-length price.
