For each Service Transponder, Customer shall be provided Service in accordance with the protection level stated in the Service Order (e.g., Fully Protected Service, Transponder Protected Service, Non-Preemptible Service, Preemptible Service or Business Preemptible Service), as such protection level is defined and as the restoration rights are set forth in the Service Order.
A Non-Preemptible Service will have no rights of Preemption and will not be subject to Preemption.
Non-Preemptible Service shall mean a Service provided according to the provisions of paragraph c) of article 10 of the Supreme Order No. 022-2005-MTC of Peru, whose transponder has back-up amplifiers, subject to availability, and is not interrupted to give priority to any Service nor any other circumstance, except in case of any default of the CLIENT duly accredited or according to the second paragraph of Section Two of this Agreement.
If service is restored on the Restoration Satellite, then Customer's service shall change to Non-Preemptible Service.
If Non-Preemptible Service is so provided, all references to the GE-3 Satellite in this Agreement shall be considered to mean the Restoration Satellite for all purposes of this Agreement; except with respect to service level (as described above) and except that (i) the technical specifications for the Restoration Satellite shall be substituted for those specifications in Attachment Al and (ii) during the period such Non- Preemptible Service is provided, the MRC specified in Article 2.
During the Service Term, EHC will provide to Customer Non-Preemptible Service on [___] Ku-Band Transponder(s) (or the equivalent thereof) on the [___] Satellite presently located at the [___]° W.▇.
Non-Preemptible Service or Non-Preemptible Transponder: A satellite service or transponder that may not be preempted at any time to restore a Protected Service or Protected Transponder, but that is not entitled to be restored by preempting a Preemptible Service or Preemptible Transponder.
Transponder, Customer's service shall remain Non-Preemptible Service, without any further right of restoration.
In the event such Non-Preemptible Service as described in the previous sentence is provided by GE Americom within the first six (6) months of Service, (no later than March 31, 2000), there shall be no such reduction to the MRC.
Preemptible Transponder means a ----------------------- --------------------------- satellite service or transponder that may not be preempted to restore another service or transponder and that is not itself entitled to be restored by preempting a Preemptible Service, but that will be restored using an on-board Replacement Transponder on board the same satellite as the Non-Preemptible Service that failed is located if Available.
