Non-Fixed Pricing. Means all Products identified as such on Attachment A or any subsequent amendment to this Agreement. Wholesale Acquisition Cost (WAC) Minus - a percentage or dollar amount off WAC that changes by providing MMCAP Infuse prior written notice of the price change along with the new WAC and contract price. Days: (Not required to be capitalized) Unless otherwise specified in this Agreement, all references to days will be calendar days. Failure to Supply (FTS): Means when the Vendor could not fulfill a combined direct and/or wholesaler purchase volume of one hundred fifty percent (150%) of the Members’ previous quarter’s volume.
