Non-Discretionary Changes definition

Non-Discretionary Changes means any modifications or changes that the Members elect or are required to make to the Plans or to the Project (other than Discretionary Changes). Non-Discretionary Changes include, for example, changes to the Plans or the constructed portions of the Project to correct design or construction deficiencies or to implement government-mandated revisions, or GC claims under the GMP Contract for increased compensation in excess of the originalContract Sum” (or similar term, as defined in the Construction Contract) for errors or inconsistencies in the Plans, concealed conditions, delay or other reasons.
Non-Discretionary Changes means any modifications or changes that the Owner is required to make to the Plans and Specifications or to the Project (other than Discretionary Changes), except a government-mandated modification or change resulting from changes in building codes or other applicable laws after the date of this Agreement. Non-Discretionary Changes include, for example, changes to the Plans and Specifications or the constructed portions of the Project to correct design or construction deficiencies or to implement government-mandated revisions not resulting from changes in building codes or other applicable laws after the date of this Agreement, or Contractor claims under the Construction Contract for increased compensation due to errors or inconsistencies in the Plans and Specifications, concealed conditions, delays or other reasons, in any such case unless resulting from a Force Majeure Event.
