Non-Derivative Claims definition
Non-Derivative Claims means any and all rights, claims, actions or causes of action of any kind and any nature that are not Derivative Claims.

All right, title and interest in any Non-Derivative Claims that the Trustee has the power to assert as of the Effective Date or thereafter, excepting only those claims released pursuant to Section 15 of this Settlement Agreement, shall be assigned to the Funds, for the benefit of the members of the Funds who hold Allowed Interests.
