Except for Delivery of Materials to BEYOND AIR, Supplier shall be responsible and liable for its and its employees’, Affiliates’ and subcontractors’ receipt, use and disposition of Materials, including a Non-Conforming Unit and a Non-Conforming Product, in violation of this Agreement.
