DHS is not obligated to take an adjudicative action while the response period for any RFE or NOID remains pending and the class member has not submitted the required response(s).
DHS will take a subsequent adjudicative action within 90 days of the receipt of the response to any Request for Evidence (“RFE”) or NOID.

In the event a Plaintiff’s failure to respond is due to circumstances beyond the control of the Plaintiff, he or she will file a request to consider a late filed response with USCIS setting forth the reasons for the untimely filing along with evidence in response to the NOID.
