Niagara s activities to support TELERGY's design, planning, construction, installation or MAINTENANCE efforts, and its conduct of periodic and post-construction inspections shall not operate to relieve TELERGY of any responsibility, obligation or liability specified in this Agreement. TELERGY shall be responsible for compliance with all Federal, state or local laws, rules, regulations, codes and/or ordinance governing the activities contemplated by this Agreement.
