Neither Network Rail nor the Train Operator shall be liable to the other in respect of any Nuclear Damage from any Nuclear Occurrence if, and to the extent that the appropriate Licensee (as the Licensee on whose behalf the Train Operator carries the Nuclear Matter) is held strictly liable pursuant to the provisions of the NI Act.
In addition, this Agreement does not affect the customer’s legal rights, including the rights under the Consumer Protection (NI) Act 1987.
