  • The New Park DDs will be consistent with the New Park Schematics to the greatest extent feasible.

  • Developer shall not be responsible for any component of the design of the New Park that is not required by (or reasonably inferable from) the New Park Schematics.

  • Within ten (10) business days after the County’s receipt of the New Park DDs, the County shall either (i) approve in writing the New Park DDs as substantially consistent with the New Park Schematics, or (ii) identify in writing, in reasonable detail, those elements of the New Park DDs that are not substantially consistent with the New Park Schematics.

  • Following Developer’s receipt of the final New Park Schematics pursuant to Section 2.04(a) as aforesaid, Site Plan Approval and the issuance of the special use permit required for the New Park, Developer shall cause an Architect engaged by Developer to prepare the following design development documents for the New Park (“New Park DDs”): landscape plans, grading plan, planting plan, lighting plan, sections and elevations with full dimensions, and outline material and equipment specifications.

  • Within ten (10) business days after Developer’s receipt of the New Park Schematics, Developer shall issue a request for competitive estimates to at least three (3) qualified contractors for construction of the New Park based on the New Park Schematics and, within ten (10) business days following receipt of all responses, shall provide the County with Developer’s good faith estimate as to the total hard cost of completing the construction of the New Park.

  • In the event that the Approved Site Plan is not consistent with the New Park Schematics (so long as such inconsistency does not arise at the request of Developer or Ground Lessee, unless otherwise approved in writing by County), Developer and the County shall cooperate in good faith to modify the New Park Schematics to conform to the Approved Site Plan.

  • On or before the date that is four (4) weeks after the Arlington County Board votes to approve this Agreement, the County shall deliver proposed New Park Schematics to Developer.
