New Batch definition

New Batch has the meaning set forth in Section 5(e)(iii)(1).
New Batch means any Batch of Commercial Product that is requested to be delivered in the Quarter newly entering the Quarterly Forecast (i.e., the Quarter that was not covered by the prior Quarterly Forecast).
New Batch means Batches of Commercial Product that are requested to be delivered in a new Year entering the Firm Period of Annual Forecast. For the avoidance of doubt, for the very first Annual Forecast, all the Batches in the Firm Period of the Annual Forecast shall be considered New Batch(es).

Examples of New Batch in a sentence

  • Each time Client submits a Quarterly Forecast to SBL pursuant to Section 5(d)(ii), SBL and Client shall discuss in good faith the Manufacturing schedule for each New Batch.

  • In August of 1997, IPLP Acquisition I, L.L.C., then an affiliate of Insignia and now our affiliate, commenced a tender offer for $275 per unit.

  • The Parties shall discuss in good-faith for up to [***] and shall agree upon a manufacturing schedule for the New Batches covered by the applicable Quarterly Forecast, upon which Client shall issue a binding Purchase Order for each New Batch which is consistent with the Parties’ agreement and the Quarterly Forecast.
