  • Customer hereby agrees that its sole remedy in respect of any breach of the said warranty is that Netcall will remedy such breach without charge to Customer and if in Netcall’s reasonable opinion, ▇▇▇▇▇▇▇ is unable to remedy any such breach then its liability for that failure is limited to refunding a reasonable portion of the fees paid for that Software (where such portion will be calculated by Netcall acting reasonably and having regard to the circumstances of the breach in question).
