In the event that the Supplier fails to keep any information up to date, NEPO or the Agent may give the Supplier notice of the failure.
Where a failure is not resolved within the timescale stated NEPO or the Agent reserve the right to for such information to be removed immediately by any means.
The Supplier shall notify NEPO and Agent if such a conflict arises.
The Parties agree that they shall bear their own respective costs and expenses incurred in respect of compliance with their obligations under this Clause 26 unless the audit reveals a material default by the Supplier in which case the Supplier shall reimburse NEPO and/or Agent for NEPO’s and/or Agent’s reasonable costs incurred in relation to the audit.
