Necessary Improvements definition

Necessary Improvements means the items categorized as “Necessary Improvements” in the B&D Report.
Necessary Improvements means Improvements that are:
Necessary Improvements means Capital Improvements that are required (i) by applicable governmental law, regulation or order, (ii) in order to obtain insurance at commercially reasonable rates; (iii) to keep the playing field, lighting and safety features of the Baseball Stadium in compliance with Baseball Rules and Regulations; (iv) other than the Team's obligation for Maintenance and Repairs, to replace components of the Leased Property at the end of their economic life cycle; or (v) to keep the Baseball Stadium on par with the upgraded facilities in at least 50% of all Major League Baseball ballparks that are governmentally owned in whole or substantial part and are more than two years old.

Examples of Necessary Improvements in a sentence

  • The Political Subdivisions recognize that reserves may not be available at all times, and they may be billed for the Cost of Replacements and Necessary Improvements as needed.

  • Reserves accumulated by UOSA may be used to the extent permitted by the Trust Agreement to meet the reasonable Cost of Replacements and Necessary Improvements, which do not increase the capacity or scope of the UOSA Plant and UOSA Delivery System.

  • The Team further agrees to hold the District and the City harmless from any and all liabilities of every kind and description which may arise out of or be connected in any way with any Major Capital Repairs, Necessary Improvements or Discretionary Improvements, including Small Projects, except to the extent any of such liabilities may be attributed to the negligence or willful misconduct of the District, the City, or their respective agents or employees.

  • The Lease shall provide that the cost of Necessary Improvements shall be paid or reimbursed to the Team from funds in the Capital Reserve Fund and that, to the extent that the funds are insufficient, the Commission shall be responsible for the difference.

  • The Club is solely and exclusively responsible for the performance of all capital maintenance, capital replacement, capital restoration, capital repairs, capital re-equipping and capital improvements (including Necessary Improvements and Upgrade Improvements) necessary to meet the Applicable Standard and to fulfill the Club’s rights and obligations under the CapEx Work Plan (the “CapEx Work”), and for all costs and expenses thereof (the “CapEx Expenses”).

  • The Operator shall be permitted to make Capital Improvements (other than Emergency Capital Repairs and Necessary Improvements) as it deems necessary or appropriate.” Section 9.2, page 34.
