NAIC Tests definition
NAIC Tests means the ratios and other financial measurements developed by the NAIC under its Insurance Regulatory Information System, as in effect from time to time.

The Borrower shall cause FIC and its Subsidiaries to maintain risk-based capital ratios that are above the minimum levels required by the NAIC Tests below which FIC or such Subsidiary may be required to take action of any kind as a result of such ratios (including communication with regulatory authorities required as a result of the failure to maintain such minimum ratio levels, etc.).
