NAIC Tests definition

NAIC Tests means the ratios and other financial measurements developed by the NAIC under its Insurance Regulatory Information System, as in effect from time to time.

  • The Borrower shall cause FIC and its Subsidiaries to maintain risk-based capital ratios that are above the minimum levels required by the NAIC Tests below which FIC or such Subsidiary may be required to take action of any kind as a result of such ratios (including communication with regulatory authorities required as a result of the failure to maintain such minimum ratio levels, etc.).
